User Agreement Overview
This document is an agreement you make with RelationFit on how to properly use its services. It explains what RelationFit provides, the risks of participating and your responsibility to exercise safely. By signing up for a RelationFit account, or attending a class, you are agreeing to its terms. Please read them carefully to ensure Relationfit is a proper fit for your needs.
The technical name for this document is: waiver and an express assumption of risk and release of liability and indemnity agreement.
What RelationFit Provides
RelationFit is a service that provides workouts to build relational fitness. Workouts will ask me to have conversations with my partner. The goal of each conversation is to build a particular set of skills.
I understand that RelationFit is not counseling, therapy or any other type of medical treatment. It is not staffed by any type of licensed healthcare providers or overseen by any regulating board. RelationFit, its presenters, coaches and content creators are not licensed, credentialed or certified to provide advice of any kind. Its content should not be taken as advice. RelationFit’s goal is to give participants exposure to a wide variety of relationship skills and a way to practice them, not provide specific treatment for any problem or condition. These skills may not be relevant to, or appropriate for a participant’s situation.
Workouts: Workouts are typically events where participants (you and a partner) meet to exercise. The goal is to carve out time in life to paractice.
Content: Content is typically material a viewer absorbs. The goal is to share personal thoughts and experiences of its author. It is delivered via lecture, article, video, infographic, book or similar. Skills, principles, opinions and examples are presented for entertainment purposes only. As described above, this content should not be taken as advice. You may experience harm or loss when putting this content into practice.
This document outlines the risks associated with both RelationFit services and its content. By continuing to use RelationFit services or its content, I certify that I am not seeking treatment of any kind from RelationFit, and that I, my partner and my relationship are healthy enough to exercise in this way. I recognize that I can stop participating during workouts, and stop viewing content at any time. I take full responsibility for assessing the workouts and content to ensure they are appropriate for me and my situation.
Participation Risks
I understand that participation in RelationFit may expose me to the risk of relational injury. I agree that it is solely my responsibility and not the responsibility of RelationFit to require me to consult with a physician, counselor, therapist religious director, or licensed professional prior to commencing any such programs, to remain under medical supervision if that is indicated, and to seek professional or medical assistance in the event an issue arises with me, my partner, or in the relationship between us. I recognize that the exercises provided by RelationFit entail some risk of an injury to myself and to others and I agree that I will exercise with due care.
Acceptance Of Risks
Injury: I hereby release RelationFit and its owners, officers, employees, agents, licensees, consultants, coaches, independent contractors and affiliates from any liability from damage, personal injuries or other claims arising from or in connection with my participation in any program in or around RelationFit.
Anonymity: I understand RelationFit uses video conferencing software and any information I type, say, or show through the camera of my computer may be seen by others, including my face, room surroundings, and name if I have typed it into the video conferencing software. I recognize my responsibility to limit what is seen and heard by others by typing and saying only what I want others to know, including use of the “mute” button. I agree the staff of RelationFit are not responsible for my voluntary or accidental disclosure of personal information. I recognize that anyone could be in the class with me and agree not to use this service if I require anonymity.
Surveys, Studies, and Publication of Results: I understand that RelationFit may from time to time send surveys to collect information to improve their service and assess the efficacy of their workouts. I understand my feedback will be shared with RelationFit staff and researchers who will publish results in scholarly journals, other publications and outlets, and select quotes for promotion on the websites and social media. Information collected in this manner will be deidentified which means my name, image and other information that could be used to identify me has been removed. My information will be anonymized. To those who read it. I hereby grant RelationFit and assign an irrevocable right, title and license to use, simulate, and impersonate my de-identified information in connection with the uses described above. Such rights are without limitation in number of occurrences or type of media, whether now, existing or hereafter created for a period of without limitation.
I understand that participation in RelationFit may expose me, my partner and my relationship to the risk of injury. I hereby release RelationFit and its owners, officers, employees, agents, licensees, consultants, independent contractors and affiliates from any liability from damage, personal injuries or other claims arising from or in connection with my participation in any exercise program in or around RelationFit.
Specific Terms Of Agreement
In consideration of being allowed to participate I/Releasor, the Member, agree and acknowledge that I am fully aware that participation in the Activity/programs/classes may involve risks and I accept all the risks of participating, even if the risks are created by the carelessness, negligence or gross negligence of a Released Party (RelationFit) or anyone else.
“Claims” includes but is not limited to any and all liabilities, claims, demands, legal actions, rights of actions for damages, personal injury or death in connection with participation in the Activity/Class. “Released Party” means RelationFit and all of the affiliates, franchisees and their respective representatives, directors, officers, agents, employees and volunteer staff.
I agree and acknowledge that:
I am in proper mental, emotional and physical condition to participate in the Activity, and am aware that participation could, in some circumstances, result in personal or relational injury;
I understand my mental, emotional and physical limitations and am sufficiently self-aware to stop any activity before I become ill or injured; and
I am aware that the Activity occurs in front of others and I will safeguard my own personal information.
I hereby, for myself and for my heirs, next of kin, executors, administrators and assigns, fully release, waive and forever discharge any and all rights or Claims I may have, now or in the future, against any Released Party, even if the Claims are based on the carelessness, negligence or gross negligence of a Released Party or anyone else. Without limiting the foregoing, I further release any recourse, which I may now or hereafter have resulting from any decision of any Released Party.
I agree not to sue any Released Party for Claims, even if the Claims arise from the carelessness, negligence or gross negligence of any Released Party or anyone else. I agree to indemnify (reimburse for any loss) and hold harmless each Released Party from any loss or liability (including any reasonable legal fees they may incur) defending any Claim made by me or anyone making a Claim on my behalf, even if the Claim is alleged to or did result from the carelessness or negligence of any Released Party or anyone else.
I am aware that it is advisable to consult a licensed mental health councilor, therapist, or physician prior to participating in the Activity. If I have consulted with a licensed healthcare provider, I have taken the provider’s advice.
I am aware that there is no obligation for any person to provide me with medical care during the Activity. I understand and acknowledge that:
There may be no aid available for the Activity; and
If medical care is rendered to me, I consent to that care if I am unable to give my consent for any reason at the time the care is rendered.
I grant my permission to the Released Party and any transferee or licensee or any of them, to utilize my de-identified information from surveys. This permission is for use anywhere in the world and on the Internet and for an unlimited period of time. I understand and agree that I will not be compensated or receive additional consideration for consenting to the use of the information and that I will not be given a chance to receive, inspect or approve the promotional or marketing material, messages and/or content that may use the information. I hereby release the Released Party including, without limitation, all persons who took or otherwise created, recorded or modified the information, from any and all claims, actions, damages, interest, costs, expense and compensation of whatsoever kind and howsoever arising, whether known or unknown, and which I now have or at any time hereafter can, shall or may have in connection with, or in any way resulting or arising from, the information and the creation, use or disposition of them.
I acknowledge and agree that the Released Party shall own all right, title and interest, throughout the world, in and to the Information and any materials compromising all or any part of the Information, and that the Released Party has the unrestricted right to use, license, sell, transfer or otherwise dispose of any or all of them, as well as the Released Party’s rights under this agreement, in any manner whatsoever and without any accountability to me. I hereby assign to the Released Party all right, title and interest, throughout the world, I may have in and to the Images and any materials comprising all or any part of the Information, including all intellectual property rights thereto. I hereby irrevocably waive any and all of my moral rights and any other irrevocable rights I may have, throughout the world, in or to the Images and any materials comprising all or part of the Information.
If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
All participants must be at least 18 years of age unless they have parental or guardian approval. If I am signing on behalf of a minor child, I also give full permission for any person connected with RelationFit to administer aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical care deemed necessary for the well being of the child.
You must be a member in good standing to be in the class.
All members, guests and visitors must sign in and accept this agreement’s terms before participating in class.
RelationFit memberships are non-transferrable, non-assignable, and non-saleable. Any such attempted transfer, assignment or sale is void and will not be honored by RelationFit .
RelationFit and its staff are not responsible for personally identifiable information (PII) shared voluntarily or accidently by you over video conferencing or survey.
Abuse of RelationFit ’s workouts, staff, or members including fighting, threatening or disrespectful behavior are grounds for immediate membership suspension and/or termination.
Termination with/without cause: RelationFit may, at its option, terminate Member’s membership if
Member fails to make timely payments under any payment plan,
Member fails to follow the RelationFit rules and regulations or this Agreement, or
Member’s conduct is improper or harmful to the best interests of RelationFit , its staff and its members. Termination for cause is effective on the date that RelationFit sends a written notice to the Member’s last known email address. RelationFit reserves the right to terminate any membership for any reason not identified in this agreement and that is not prohibited by law. If RelationFit terminates a membership under this provision, RelationFit will send notice by email to the Responsible Party/Participant and refund any unused prepaid dues.
RelationFit reserves the right to refuse entry or membership to anyone.
This agreement constitutes the entire and exclusive agreement between the parties and cancels and supersedes prior promises, representations, understandings and/or agreements between the parties. This agreement maybe modified only by an instrument in writing signed by all parties.
I have fully read and understand the foregoing release and waiver. I am aware that by signing this release and waiver, I am waiving certain legal rights I or my heirs, next of kin, executors, administrators and assigns may have against the Released Party.
